Again, this works perfectly fine in practice. A parent having that photo is not in itself a crime, but when it becomes a crime and rightly so is when said parent distributes that photograph to dodgy characters. I’ll also say from personal experience, I’ve seen court cases where such images were common taken and it was generally because the father was a pedophile.
Ultimately though, it’s down to intent, what happens with the images, and numerous other factors determined in the case.
The media likes to sensationalise a lot of what happens and legal decisions, but there’s often a great deal more nuance in the case itself.
